Time: Catholic Bishops Should Go to Jail If They Want to Protest Obamacare Mandates

On the Time Ideas blog, Harvard administrator Erika Christakis dismissed all the “hysteria with a fever pitch” about religious liberty, insisting that if the Catholic bishops don’t like the Obama administration making them pay for contraceptives, abortifacients, and sterilizations, they could do the MLK/Mandela thing and go to prison in an act of civil disobedience. That's the way liberals say "put up or shut up."

“Let’s see what our society would look like if we all had the luxury of imposing our unfettered will," Christakis lectured, as if that's not what Obama is doing. “At a minimum, the Catholic bishops and employers resisting contraceptive coverage should be willing to pay for the care of all those unwanted children. Or perhaps they’d be willing to spend some time in jail in protest. At my taxpaying expense, of course.”

The link took Time readers to a February 13 dispatch by Time reporter Tim Padgett headlined "Birth Control Debate: Why Catholic Bishops Have Lost Their Grip on U.S. Politics -- and Their Flock."

Christakis tried to construct a scenario where the Catholic bishops were infringing on the "rights of millions of people who are burdened by unplanned pregnancy," as if each one of them was on the health plan of a Catholic charity or school. To liberals, a "right" is often a subsidy, and freedom equals free stuff.

People who cry moral indignation about government-mandated contraception coverage appear unwilling to concede that the exercise of their deeply held convictions might infringe on the rights of millions of people who are burdened by unplanned pregnancy or want to reduce abortion or would like to see their tax dollars committed to a different purpose.

Why should an employer’s right to reject birth-control coverage trump a society’s collective imperative to reduce unintended pregnancy? Should employers be allowed to withhold a polio vaccine or cataract surgery or safe working conditions on similar “moral” grounds?

Christakis is filling a fish bowl with red herrings. She also tartly asserted that "Americans generally understand that their world doesn’t collapse when they are forced to live with decisions and values with which they disagree. It seems people are quite willing to be flexible on most matters, except in an election year and where sex is involved."

Every few paragraphs, Time salted this blog post with links to other liberal effluvia from their website, dismissing the idea there was any "war on religion" and that Obama had an "Anglican solution" to the contraceptive debate, and of course, the shrieking will-birth-control-be-banned piece we've already mentioned.

Of course, these Bishops are Christians. So, what about...Are American Muslims exempt from the requirement to purchase health insurance under the individual mandate of the Patient Protection and Affordable Care Act (PPACA)?

There has been a lot of talk, and a number of Internet rumors, to the effect that Muslims are exempt from the PPACA’s individual mandate; that Muslims will get free health care under the PPACA, while the non-Muslim population of the United States will be required to purchase government administered health insurance. Therefore, according to rumor, non-Muslim Americans will be paying for American Muslims’ health care; in other words “dhimmitude.” There is even a rumor that the word “dhimmitude” –used to denote subservience to Islam by non-Muslims, is actually used—on p. 107 of H.R. 3590 of the PPACA bill.

The rumors of free health care for Muslims are based on Shariah law’s prohibition on insurance. Insurance violates the tenets against riba (interest); al-maisir (gambling) and al-gharar (uncertainty). Interest paid on insurance investments violates Shariah’s rules against usury. Thus, under a strict interpretation of the Koran, Muslims are exempt from ObamaCare. However, the talk and the rumors are false—the word “dhimmitude” isn’t used anywhere in H.R. 3590, and depending on how PPACA rules are applied, there is at least an even chance that the scenario of American Muslims being exempt from the requirement to purchase insurance under the individual mandate won’t play out.

To be sure, the PPACA does grant a number of exemptions from the requirement to purchase the “minimum essential coverage.” (Whatever that is — Health and Human Service Secretary Kathleen Sebelius hasn’t yet defined it.) Prisoners, illegal aliens, and foreign nationals are exempt. In addition, there is a religious exemption. Under Subtitle F, Part I, Section 1501—the individual responsibility requirement to maintain minimum essential coverage—individuals must be “a member of a recognized religious sect” that doesn’t participate in Social Security. According to a January 2011 Heritage Foundation WebMemo, they must pay no Social Security taxes and receive none of the benefits, in accordance with Section 1402(g)(1) of the Internal Revenue Code. The religious exemption applies to any person who is a member of a “recognized religious sect or division” with “established tenets or teachings” that would forbid that person from accepting public or private insurance. Thus the Amish, who believe in taking care of their own elderly and don’t participate in Social Security, are exempt, as are Mennonites and Scientologists.

Catholic institutions refuse to provide the healthcare required (many are self-insuring so there is no insurance company).
The Obama admin fines them for non-compliance with HHS rules.
Catholic Institutions refuse to pay the fine.
The Obama Admin brings a criminal suit against the Catholic Institutions.
[by this time Obama has lost the election and a new admin is sworn in]
Law suits are dropped
HHS rules are changed [maybe HHS is abolished depending on who is president]

I fail to see how anyone "goes to jail" over covering contraception in health insurance or not.

You can not compare the immoral act of the willful slaughter of innocents with with the moral act of vaccination against deadly disease.

Being Pregnant is not an illness nor a physical defect. It is entirely preventable, just place an aspirin between your knees and hold that position until the urge passes.

Read the First Amendment of The Constitution. It is very clear!

In Christakis' view it is all well and good if you would like to pray quietly to yourself and I suppose she will put up with some hymn singing and lighting of candles, but when it comes to something like paying for other peoples contraceptives, and abortions, a fundamental tenet of Catholic faith, she can tolerate no dissent. You must submit to the will of the state and you must pay.

If he's not a socialist, then what is he, a free-market champion?
